Current Cannabis Laws
Possession: Alaskan state laws for possession of cannabis are comparatively lenient, if followed precisely. Possession of up to 4oz of cannabis in Alaska is decriminalized and has no penalty…if possession occurs inside the residence of the owner.
Public use or display of up to 4oz of cannabis in Alaska is still considered a misdemeanour and can result in a year-long prison sentence.
Possession of over 4oz of cannabis under any circumstance is considered a felony punishable by up to 5 years in prison.
Sale: The distribution of 1oz or less of cannabis is considered a misdemeanour in Alaska, punishable by up to a year-long prison sentence. Sale of over 1oz is considered a felony, resulting in a possible 5 year sentence.
Cultivation: An Alaskan may cultivate 25 or less cannabis plants in a private residence without any penalty, under right to privacy laws. Cultivation of 25 or more plants is still considered a felony, with a 5 year prison sentence the maximum penalty.
Medical Marijuana: In 1998, 58% of Alaskan voters approved ‘Measure 8’, legalizing medical marijuana for Alaskans who possess written documentation from their physician suggesting that marijuana will significantly help their condition.
Latest Legal News: After 45,000 signatures were gathered in January 2014, supporting changes in laws regarding cannabis in Alaska, an 8 page act regarding regulation of marijuana sales in the state will appear in the November 2014 primary election ballot. Current prediction suggest that their will be a 55% vote swing in favour of the new law.
