Is it Legal to Buy Cannabis Seeds Online?

The laws on cannabis are constantly evolving worldwide. More and more countries are beginning to tear down restrictions on medical and personal use, but cultivation is still illegal in many places. As for cannabis seeds, the laws are altogether trickier to follow. Is it legal to buy cannabis seeds online? If so, can you grow them into plants? Not necessarily. We’ll look at laws around the world and what it means for you.

The law on buying cannabis seeds isn’t as straightforward as you’d hope. Depending on where you are in the world, there’s a different set of rules around each specific law, which can get confusing. United Kingdom

Buying cannabis seeds online is perfectly legal, so get along to and fill your basket. Here’s the tricky part: you can buy seeds but can’t legally grow cannabis in the UK. You’re deemed to have broken the law as soon as you germinate those seeds. So while you can purchase marijuana seeds from a reputable seed bank, if you mention germination in your communications, you’re seen as buying “with intent to cultivate,” and as such, you’re engaging in illegal activity.

The laws on cannabis in the weed capital of Europe are confusing. You may legally purchase cannabis seeds, sure – but believe it or not, cannabis is still illegal in The Netherlands. And you may ask, “but what about all those coffee shops?”.

Cannabis is allowed under a strangely liberal ‘tolerance policy’, meaning it’s allowed but illegal. How can that be? Cultivation of cannabis plants is also illegal, although there’s a tolerance policy for a small number of plants if grown for personal use. Clear as mud.


Buying cannabis seeds in Spain is legal, and the Spanish government has relaxed weed laws. If it’s for “personal use in a private area” then it’s all good. You can buy, germinate, grow your own cannabis and use it without falling foul of the authorities. Keep the quantities low, however, as any perceived intent to traffic cannabis is still very much a criminal offence.


If you have a prescription, medical cannabis use in Germany is legal. The subject of buying seeds is a good bit more complicated, though. The sale of cannabis seeds in Germany is prohibited, making Germany the only country in Europe where this is the case. The good news is that due to EU trade regulations surrounding the free movement of goods, you may still buy cannabis seeds and import them to Germany.


Buying cannabis seeds is legal in Italy; even better, seeds are easily obtainable. But like in the UK, any growing activity is illegal, meaning you’re breaking the law as soon as you germinate your seeds. There are numerous reports of people who’ve been let off lightly when caught with small amounts (personal use), but you should always stick within the confines of the law.


Cannabis seeds are legal in France, but any cultivation is against the law. France takes a fairly hardline approach when it comes to cannabis; possession, use, growing, buying and selling cannabis are all illegal activities that carry fines and prison sentences. And while seeds are legal, you can’t legally buy them in France, so like in Germany, you have to order online.

As for the rest of Continental Europe, check the laws in your region and act accordingly. If you buy the seeds, you are responsible for any fines or punishments accompanying this kind of transaction. Know the law and stay within the boundaries.

In many European countries, it’s legal to buy or possess cannabis seeds as long as they’re not for cultivation. Examples of this include buying seeds for genetic preservation or as a collector.

Can I buy Cannabis Seeds in Other States or Countries?


The United States is altogether different, and cannabis law can vary widely from one state to the next. While cannabis seeds are prohibited under federal law in every state, several states have authorised medical marijuana, with others going so far as to legalise recreational pot. Even at that, the legality of purchasing seeds can vary, so it’s best to carry out due diligence and know the laws for your specific region. It’s important to know that while seeds may be legal in your state, due to state line restrictions, you probably won’t be allowed to ship them across states – and vice versa. So if they’re illegal where you are, you can’t buy them from a legal state and ship them to your state freely. Unfortunately, this is the opposite of the EU model and means far greater restrictions.

The United States also forbids the import of cannabis seeds from other countries, meaning you can’t buy seeds from Europe and legally ship them to your address in America. US Customs would seize the package and may just come knocking at your door, and good luck passing your cannabis seeds off as bird food.

South America

Legislation in South America is like most other places and is a mish-mash of red and green lights. Uruguay, for example, has legalised cannabis in the hope that this will curb illegal trafficking. Brazil, on the other hand, sits somewhere in the middle and can’t seem to decide whether cannabis should be legal or prohibited entirely. The good news is that cannabis seeds are legal – in principle. Like anywhere else, it’s best to research the law for your region as the penalties for breaking the drug laws can be pretty severe.


The laws around cannabis in Australia are hard to follow. It’s legal in the Australian Capital Territory, but elsewhere prohibition is still very much in effect. As for buying seeds online in Australia, that’s illegal, too – whether buying internally or importing seeds.
